Terms of Service

1. The Service

Outcited is a software tool that helps you measure and improve how often your brand is cited by AI answer engines (such as ChatGPT, Claude, and Gemini). It generates and rewrites content, tracks AI bot crawls, and can publish content to connected platforms. The service is provided on an “as is” and “as available” basis and we may add, change, or remove features over time.

2. Accounts & Eligibility

You must be at least 16 years old and able to form a binding contract to use Outcited. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Authentication is handled by our identity provider (Clerk). Notify us immediately at support@outcited.co if you suspect unauthorized use of your account.

3. Subscriptions & Billing

• Paid plans may include a 7-day free trial. If you cancel before the trial ends, you will not be charged. If you do not cancel, your subscription begins automatically and your payment method is charged when the trial ends.
• Paid plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose) through our payment processor, Stripe.
• Your subscription renews automatically at the end of each billing period until you cancel. You can cancel at any time from your billing settings.
• Plan limits (such as the number of domains, tracked queries, or content generations) are described at checkout and in your dashboard. We may change pricing with notice; changes apply to the next billing period.
• Refunds are governed by our Refund Policy.

4. Acceptable Use

You agree not to:

• Use Outcited for any unlawful, deceptive, or harmful purpose, or to generate spam, malware, or misleading content;
• Attempt to reverse-engineer, scrape, overload, or disrupt the service or its underlying infrastructure;
• Resell, sublicense, or provide the service to third parties except as expressly permitted by your plan;
• Abuse, probe, or attempt to manipulate the AI features (for example, prompt injection or using the assistant for unrelated general-purpose tasks);
• Publish content you do not have the rights to, or content that infringes the rights of others.

We may suspend or terminate accounts that violate these rules.

5. Your Content

You retain ownership of the domains, business information, and content you submit to Outcited (“Your Content”). You grant us a limited license to process Your Content solely to operate and improve the service for you - for example, to analyze your site, generate content drafts, and publish to platforms you connect. You are responsible for reviewing and approving any AI-generated content before you publish it.

6. AI-Generated Content & No Guarantees

Outcited uses third-party AI models to analyze visibility and draft content. AI output can be inaccurate, incomplete, or out of date. We do not guarantee any specific result, including that your brand will be cited by any AI engine, rank in any search or answer engine, or achieve any particular traffic or revenue outcome. You are responsible for fact-checking and editing all output before use.

7. Third-Party Services & Integrations

Outcited connects to third-party platforms (such as your CMS, hosting, or analytics tools) and relies on providers including Clerk, Stripe, Vercel, and Neon. Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy, or actions of third-party services, and connecting them is at your own risk.

8. Intellectual Property

Outcited, including its software, design, and branding, is owned by us and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or to copy, modify, or create derivative works of the service, except for the limited right to use it as intended under your plan.

9. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Outcited and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

11. Termination

You can stop using Outcited and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination, your right to use the service ends; sections that by their nature should survive (such as content ownership, disclaimers, and liability limits) will continue to apply.

12. Changes to These Terms

We may update these Terms as the service evolves. We will post the updated version here with a new “Last updated” date, and for material changes we will make reasonable efforts to notify you. Continued use after changes take effect means you accept the updated Terms.

13. Governing Law & Disputes

These Terms and any dispute arising from them or from your use of Outcited are governed by the substantive laws of Switzerland, without regard to conflict-of-law rules. To the extent permitted by law, the ordinary courts at our registered seat in Aesch, Canton of Basel-Landschaft, Switzerland, have exclusive jurisdiction. Nothing in this section deprives you of the protection of any mandatory consumer-protection law that applies in your country of residence.
